<P ALIGN=LEFT><FONT FACE="Times New Roman">Segundo relatou a ouvidora da</FONT><B> <FONT FACE="Times New Roman">Secretaria de Políticas para as mulheres</FONT></B><FONT FACE="Times New Roman">, Ana Paula Gonçalves, os depoimentos e demandas de</FONT><B> <FONT FACE="Times New Roman">mulheres</FONT></B><FONT FACE="Times New Roman"> ao órgão, por meio da ouvidoria, foram fundamentais no processo da criação da lei.</FONT><B></B><FONT FACE="Times New Roman"> </FONT></P>
<P ALIGN=LEFT><FONT FACE="Times New Roman">- Quando começamos em 2003, as grandes reivindicações das</FONT><B> <FONT FACE="Times New Roman">mulheres</FONT></B><FONT FACE="Times New Roman"> eram a inexistência de serviços de proteção às</FONT><B> <FONT FACE="Times New Roman">mulheres</FONT></B><FONT FACE="Times New Roman"> e a inexistência de uma legislação de proteção. Muitos dos artigos que constam hoje na lei estão graças a essas</FONT><B> <FONT FACE="Times New Roman">mulheres</FONT></B><FONT FACE="Times New Roman"> e a esses depoimentos. </FONT></P>
<P ALIGN=LEFT><FONT FACE="Times New Roman">Ana Paula classificou o trabalho das ouvidorias como um "termômetro" da sociedade. </FONT></P>
<P ALIGN=LEFT><FONT FACE="Times New Roman">A elaboração da</FONT><B> <FONT FACE="Times New Roman">Lei Maria da Penha</FONT></B><FONT FACE="Times New Roman"> começou em 2004, por meio de um consórcio de organizações</FONT><B> <FONT FACE="Times New Roman">feministas</FONT></B><FONT FACE="Times New Roman">, da sociedade civil, operadores do direito, servidores da segurança pública e da</FONT><B> <FONT FACE="Times New Roman">Secretaria de Políticas para as mulheres</FONT></B><FONT FACE="Times New Roman">. Um anteprojeto foi encaminhado para a Câmara dos Deputados naquele ano. No Senado, chegou em 2006 e tramitou em quatro meses. O texto foi aperfeiçoado por meio de amplo debate realizado no país e aprovado nas duas Casas do Congresso.</FONT><B></B><FONT FACE="Times New Roman"> </FONT></P>
<P ALIGN=LEFT><FONT FACE="Times New Roman">Outra resposta da</FONT><B> <FONT FACE="Times New Roman">Secretaria de Políticas para as mulheres</FONT></B><FONT FACE="Times New Roman"> às demandas recebidas por meio da Ouvidoria foi a expansão da cobertura da</FONT><B> <FONT FACE="Times New Roman">Central de Atendimento à Mulher</FONT></B><FONT FACE="Times New Roman">, o</FONT><B> <FONT FACE="Times New Roman">ligue 180</FONT></B><FONT FACE="Times New Roman">, para o</FONT><B> <FONT FACE="Times New Roman">exterior</FONT></B><FONT FACE="Times New Roman">. Desde novembro de 2011, o serviço que orienta as</FONT><B> <FONT FACE="Times New Roman">mulheres</FONT></B><FONT FACE="Times New Roman"> brasileiras em situação de violência sobre seus direitos abrange também Espanha, Itália e Portugal. </FONT></P>
<P ALIGN=LEFT><FONT FACE="Times New Roman">Segundo Ana Paula, a criação de um canal para recebimento de demandas no</FONT><B> <FONT FACE="Times New Roman">exterior</FONT></B><FONT FACE="Times New Roman"> é resultado do aumento das denúncias de violência contra as</FONT><B> <FONT FACE="Times New Roman">mulheres</FONT></B><FONT FACE="Times New Roman"> brasileiras que vivem em outros países. Nos últimos dois anos, a Ouvidoria da Mulher registrou 20 processos instaurados por</FONT><B> <FONT FACE="Times New Roman">mulheres</FONT></B><FONT FACE="Times New Roman"> nessas condições.</FONT><B></B><FONT FACE="Times New Roman"> </FONT></P>
<P ALIGN=LEFT><FONT FACE="Times New Roman">Ela explicou que se repetem casos em que a mulher brasileira deixa o companheiro e o país onde residiam com seus filhos ou filhas, em busca de proteção no Brasil, após ser vítima de</FONT><B> <FONT FACE="Times New Roman">violência doméstica</FONT></B><FONT FACE="Times New Roman">. Ao chegar aqui, entretanto, acrescentou, ela é acusada de "sequestro internacional". </FONT></P>
<P ALIGN=LEFT><FONT FACE="Times New Roman">- Nas estatísticas eles [os casos] somem, mas o processo todo demanda contato com a mulher, resgate de provas no</FONT><B> <FONT FACE="Times New Roman">exterior</FONT></B><FONT FACE="Times New Roman">, enfim, são vários procedimentos que fazemos que muitas vezes não se refletem nos dados. </FONT></P>
<P ALIGN=LEFT><FONT FACE="Times New Roman">Ana Paula relatou que, desde o início das atividades da ouvidoria, em 2003, até o final de 2011, o canal de comunicação atendeu 5.012 casos. No ano passado, foram registradas 1.311 demandas. Entre os relatos mais comuns registrados em 2011, estão denúncias de cárcere privado (40%),</FONT><B> <FONT FACE="Times New Roman">discriminação</FONT></B><FONT FACE="Times New Roman"> de gênero (8%),</FONT><B> <FONT FACE="Times New Roman">violência doméstica</FONT></B><FONT FACE="Times New Roman"> (7%) e</FONT><B> <FONT FACE="Times New Roman">tráfico de mulheres</FONT></B><FONT FACE="Times New Roman"> (5%). </FONT></P>
<P ALIGN=LEFT><FONT FACE="Times New Roman">A</FONT><B> <FONT FACE="Times New Roman">Central de Atendimento à Mulher</FONT></B><FONT FACE="Times New Roman"> funciona 24 horas por dia, de segunda a domingo, inclusive feriados. A ligação é gratuita e o atendimento é de âmbito nacional.</FONT><B></B><FONT FACE="Times New Roman"> </FONT></P>

<P ALIGN=LEFT><FONT FACE="Times New Roman">O papel das ouvidorias - como canal de comunicação direta entre cidadãos e governo - para a consolidação da democracia brasileira foi um dos destaques da audiência pública que o Senado realizou na manhã desta segunda-feira (27). Edson Vismona, da Associação Brasileira de Ouvidores, ressaltou que "as ouvidorias estimulam a participação das pessoas e permitem a solução democrática de conflitos entre o Estado e os cidadãos ou entre as empresas e os cidadãos". </FONT></P>
<P ALIGN=LEFT><FONT FACE="Times New Roman">Para Vismona, esse é um canal de comunicação privilegiado para a discussão de "conflitos que se dão no dia a dia, que podem envolver desde problemas na conta de luz até a defesa de direitos humanos". As ouvidorias, disse, "podem cuidar da pessoa, do 'detalhe', e por isso têm uma inserção na sociedade que o Ministério Público, por exemplo, talvez não tenha". </FONT></P>
<P ALIGN=LEFT><FONT FACE="Times New Roman">Ao lembrar que a atuação das ouvidorias passou a ter mais incentivos após o fim da ditadura militar, Vismona explicou que, com o processo de redemocratização do país, verificou-se a necessidade de se criar mais "canais institucionais de abertura para a sociedade". </FONT></P>
<P ALIGN=LEFT><FONT FACE="Times New Roman">- Nosso desafio permanente é transformar enunciados de princípios, como os que estão na Constituição, em exercício prático e cotidiano. E é nesse contexto que aparece a força das ouvidorias - reiterou. </FONT></P>
<P ALIGN=LEFT><FONT FACE="Times New Roman">Direitos humanos </FONT></P>
<P ALIGN=LEFT><FONT FACE="Times New Roman">A</FONT><B> <FONT FACE="Times New Roman">Lei Maria da Penha</FONT></B><FONT FACE="Times New Roman"> (Lei 11.340/06) foi citada durante a audiência como um exemplo de avanço impulsionado pelas ouvidorias. Segundo Ana Paula Gonçalves, ouvidora da</FONT><B> <FONT FACE="Times New Roman">Secretaria de Políticas para as mulheres</FONT></B><FONT FACE="Times New Roman">, órgão vinculado à Presidência da República, os depoimentos e as demandas de</FONT><B> <FONT FACE="Times New Roman">mulheres</FONT></B><FONT FACE="Times New Roman"> recolhidos por meio desse canal foram fundamentais para a existência dessa lei. </FONT></P>
<P ALIGN=LEFT><FONT FACE="Times New Roman">Outro assunto relacionado aos direitos humanos foi abordado por Renato Ferreira, da Secretaria de Políticas de Promoção da Igualdade Racial (também vinculada à Presidência da República). Ele informou que, por meio das denúncias que a ouvidoria desse órgão recebe, pode-se constatar que "há um racismo institucional no aparelho judicial brasileiro" - que se revela na falta de disposição das autoridades para levar a julgamento ou a conhecimento práticas de</FONT><B> <FONT FACE="Times New Roman">discriminação</FONT></B><FONT FACE="Times New Roman"> racial. </FONT></P>
<P ALIGN=LEFT><FONT FACE="Times New Roman">- Por causa disso, a vítima do racismo muitas vezes não vê a autoridade como um aliado. Daí a importância da ouvidoria da Secretaria da Igualdade Racial - argumentou ele. </FONT></P>
