Com as novidades do Código, alguns casos de violência contra a mulher passam a ser encarados de forma mais branda e situações como o</FONT><B> <FONT FACE="Times New Roman">estupro</FONT></B><FONT FACE="Times New Roman"> coletivo e o</FONT><B> <FONT FACE="Times New Roman">estupro</FONT></B><FONT FACE="Times New Roman"> por fraude nem chegam a ser mencionados no novo texto.</FONT></P>
<P ALIGN=LEFT><FONT FACE="Times New Roman">Segundo a assistente técnica do Cfemea, Leila Rebouças, o novo Código é um retrocesso no que diz respeito à</FONT><B> <FONT FACE="Times New Roman">Lei Maria da Penha</FONT></B><FONT FACE="Times New Roman">. Ela afirma que os movimentos</FONT><B> <FONT FACE="Times New Roman">feministas</FONT></B><FONT FACE="Times New Roman"> e a sociedade civil precisam se unir para propor alterações ao novo Código que garantam a efetivação da</FONT><B> <FONT FACE="Times New Roman">Lei Maria da Penha</FONT></B><FONT FACE="Times New Roman">.</FONT></P>
<P ALIGN=LEFT><FONT FACE="Times New Roman">"A reforma prevê a substituição da pena por medidas alternativas no crime de lesão corporal, isso inclui violência domestica. Outro ponto é a equiparação de violência sexual à prostituição. Além disso, o texto não menciona feminicídio, nem o</FONT><B> <FONT FACE="Times New Roman">estupro</FONT></B><FONT FACE="Times New Roman"> corretivo [realizado com a finalidade de cura da homossexualidade]".</FONT></P>
<P ALIGN=LEFT><FONT FACE="Times New Roman">O novo Código prevê ainda a exclusão do</FONT><B> <FONT FACE="Times New Roman">estupro</FONT></B><FONT FACE="Times New Roman"> mediante fraude, aquele que é realizado por meio de drogas, como no golpe boa noite Cinderela [em que a vítima é drogada para que fique inconsciente]. E elimina o parágrafo nono da</FONT><B> <FONT FACE="Times New Roman">Lei Maria da Penha</FONT></B><FONT FACE="Times New Roman">, que previa aumento na pena em caso de violência domestica.</FONT></P>
