<P ALIGN=LEFT><FONT FACE="Times New Roman">DE BRASÍLIA - O Superior Tribunal de Justiça unificou sua jurisprudência para considerar que qualquer modalidade de estupro ou atentado violento ao pudor (ato sexual sem penetração vaginal) é crime hediondo. A decisão vale para crimes cometidos antes de 2009, quando uma mudança na lei unificou os dois tipos e acabou com a divergência. </FONT></P>
<P ALIGN=LEFT><FONT FACE="Times New Roman">Até então, parte da doutrina e dos tribunais considerava crimes hediondos apenas os estupros e atentados violentos ao pudor dos quais resultassem lesão corporal grave ou morte. </FONT></P>
<P ALIGN=LEFT><FONT FACE="Times New Roman">O crime hediondo se difere do comum por não aceitar anistia ou indulto. Além disso, todos os crimes hediondos são inafiançáveis, a pena começa a ser cumprida em regime fechado e o condenado precisa cumprir 2/5 da pena para progredir de regime -o criminoso comum deve cumprir 1/6. </FONT></P>
<P ALIGN=LEFT><FONT FACE="Times New Roman">Com a unificação em 2009, pacificou-se o entendimento de que o estupro simples já é considerado crime hediondo. Ficou a dúvida, entretanto, quanto aos crimes cometidos antes dessa data, que ainda estão sendo julgados no STJ. </FONT></P>
<P ALIGN=LEFT><FONT FACE="Times New Roman">Na quarta, o tribunal deu ganho de causa ao Ministério Público, que pedia que um acusado de atentado violento ao pudor fosse julgado por crime hediondo. A decisão uniformiza a jurisprudência do tribunal: todos os recursos que forem levados ao STJ sobre o tema terão a mesma solução. </FONT></P>
