<P ALIGN=LEFT><FONT FACE="Times New Roman">O STJ (Superior Tribunal de Justiça) determinou que a Justiça do Ceará julgue, com rapidez, a ação penal em que um policial militar é acusado de ter estuprado uma adolescente de 16 anos. O</FONT><B> <FONT FACE="Times New Roman">estupro</FONT></B><FONT FACE="Times New Roman"> teria acontecido no exercício da função pública, enquanto a vítima era conduzida até a delegacia.</FONT><B></B></P>
<P ALIGN=LEFT><FONT FACE="Times New Roman">De acordo com a acusação,</FONT><B></B> <FONT FACE="Times New Roman">o policial determinou que o motorista estacionasse o carro em uma estrada rural e violentou a adolescente.</FONT><B></B></P>
<P ALIGN=LEFT><FONT FACE="Times New Roman">O réu responde pelo crime descrito no artigo 213, parágrafo 1º, do Código Penal. A defesa pediu a concessão de habeas corpus pelo STJ com a alegação de que houve constrangimento ilegal praticado pelo TJ-CE (Tribunal de Justiça do Ceará), ao negar a ordem para revogar a prisão cautelar do réu.</FONT></P>
<P ALIGN=LEFT><FONT FACE="Times New Roman">A defesa alegou que a prisão cautelar foi desprovida de fundamentação. Além disso, o policial se encontra preso há mais de cinco meses sem que a instrução criminal tenha sido concluída, o que caracterizaria violação da garantia da duração razoável do processo.</FONT></P>
<P ALIGN=LEFT><FONT FACE="Times New Roman">O desembargador convocado Campos Marques, relator do pedido, entendeu que a prisão do policial encontra-se fundamentada, em razão de sua periculosidade e por se tratar de um agente da lei.</FONT></P>
<P ALIGN=LEFT><FONT FACE="Times New Roman">Alinhada à jurisprudência do STF (Supremo Tribunal Federal), que não mais admite a impetração de habeas corpus em substituição a recurso ordinário, a Quinta Turma não conheceu do pedido. A Turma, entretanto, determinou que o juízo processante acelere o julgamento da ação penal.</FONT></P>
