<P ALIGN=LEFT><FONT FACE="Arial">O Banco Santander terá que indenizar uma ex-funcionária que foi vítima de boatos espalhados por um gerente que afirmavam que ela tinha fraudado a empresa, fato que não foi comprovado, de acordo com informações da assessoria de imprensa do Tribunal Superior do Trabalho (TST) divulgadas nesta terça-feira.</FONT></P>
<P ALIGN=LEFT><FONT FACE="Arial">A trabalhadora alegou ter sofrido discriminação e preconceito após sua demissão sem justa causa de uma agência de Ribeirão Preto, interior de SP, pois boatos afirmavam que o motivo real da dispensa teria sido o envolvimento dela em operações fraudulentas de crédito. Segundo a ex-funcionária, os boatos ultrapassaram as barreiras do banco e chegaram a clientes e familiares, o que lhe causou transtornos e dificuldades para arrumar outro emprego.</FONT></P>
<P ALIGN=LEFT><FONT FACE="Arial">A Vara do Trabalho de Ribeirão Preto (SP) reconheceu que houve dano moral e condenou o Banco a pagar R$ 266 mil reais de indenização com base em provas testemunhais. O banco recorreu da decisão, mas ela foi mantida pelo Tribunal Regional do Trabalho (TRT). O TST reduziu o valor da indenização arbitrado inicialmente em R$ 266 mil pelo Tribunal Regional do trabalho (TRT) de São Paulo. Segundo o relator do processo, ministro Hugo Carlos Scheuermann, a diminuição do valor visa atender aos princípios da proporcionalidade.</FONT></P>
<P ALIGN=LEFT><FONT FACE="Arial">Procurado, o banco Santander afirmou que "não se pronuncia em casos subjudice", ou seja, casos que ainda não tiveram uma decisão definitiva da Justiça.</FONT></P>
